CONDITIONS OR RESTRICTIONS ON THE PROVISION OF GOODS OR SERVICES ON THE PLATFORM

Applicable to the Blogbio Platform

INTRODUCTION

This document is specifically developed for Blogbio based on the nature of its Website Builder/SaaS services, Terms of Service, Privacy Policy, Content Policy, Pricing Policy, Payment Policy, and product documentation provided by Metaconex.

These conditions and restrictions are intended to ensure that services are provided safely, reliably, within the scope of the applicable service plans, and in compliance with applicable laws and regulations. Where technical processes, products, or commercial information change, the information published on Blogbio shall be updated accordingly and consistently.

1. SCOPE OF SERVICE PROVISION

Blogbio provides online website creation and management services under a Software-as-a-Service (SaaS) model. Users are granted access to the platform, dashboard, and features corresponding to the service plan they have subscribed to.

The services may include:

  • Website creation and management;

  • Content and article management;

  • Website interface and structure management;

  • Connection of domains or subdomains;

  • Management of resources allocated under each service plan;

  • Administrative, publishing, and integration features as published by Blogbio;

  • Additional services or advanced features where separately subscribed to by the user.

Blogbio does not transfer ownership of the software, source code, technical systems, or intellectual property rights in the platform to users, unless otherwise agreed in writing.

The right to use the services is limited to the scope, duration, and conditions of the service plan subscribed to by the user or otherwise confirmed by Blogbio.

2. CONDITIONS FOR USING THE SERVICES

To use Blogbio, users must:

  • Provide accurate, complete registration information that they are legally entitled to use;

  • Complete account verification when required by Blogbio;

  • Have lawful rights to use the content, domain, account, or resources connected to the service;

  • Pay all applicable fees for paid services in full;

  • Comply with the Terms of Service and policies published by Blogbio;

  • Not use the platform for unlawful purposes or in a manner that infringes upon the rights of third parties.

Blogbio may request additional verification where it detects transactions, accounts, or activities showing signs of abnormal or suspicious behavior.

If a user fails to complete required verification, Blogbio may restrict certain functions or delay activation of the services until the relevant requirements have been satisfied.

3. SCOPE OF USAGE RIGHTS BY SERVICE PLAN

Each Blogbio service plan may have different usage rights and limitations.

Limitations may include:

  • Number of websites;

  • Number of articles;

  • Storage capacity;

  • Bandwidth;

  • Number of accounts or administrators;

  • Number of connected Fanpages or accounts;

  • Number of group members;

  • Number of Proxies;

  • Number of Facebook accounts;

  • Access to the Facebook Advertising Module (Ads);

  • Administrative, publishing, or integration features;

  • Level of technical support.

Information regarding the limitations applicable to each service plan is published on the Pricing page or displayed during the service registration process.

Users may not exceed the limitations of their service plan for the purpose of avoiding an upgrade or the purchase of additional resources where Blogbio has established corresponding usage limits.

4. RESOURCE AND FEATURE LIMITATIONS

To ensure system stability and fair allocation of resources, Blogbio may impose limits on:

  • Storage capacity;

  • Bandwidth;

  • Request frequency;

  • Number of operations performed within a given period;

  • Number of websites or accounts;

  • Number of connections to external services;

  • Processing resources and other technical limitations.

When a user reaches an applicable limit, Blogbio may:

  • Display or notify the user of their usage level;

  • Require an upgrade to a higher service plan;

  • Require the purchase of additional resources;

  • Temporarily restrict operations exceeding the applicable limit;

  • Reject requests that exceed the service capacity available under the user's plan.

Blogbio will not automatically charge additional fees when a user exceeds a limit unless an additional-fee mechanism has been clearly disclosed and accepted by the user.

5. CONDITIONS APPLICABLE TO WEBSITES AND CONTENT

Users are responsible for all websites, content, and resources created, uploaded, stored, or published through Blogbio.

Websites and content must:

  • Comply with applicable laws and regulations;

  • Not infringe the intellectual property rights of any third party;

  • Not contain malware or tools that may adversely affect the system;

  • Not be used for fraud, phishing, or impersonation;

  • Not unreasonably interfere with the operation of Blogbio;

  • Comply with the Content Policy and other applicable policies.

Blogbio may review, restrict, or take action against content where there are reasonable grounds to believe that such content violates applicable laws or policies or poses a risk to users or the system.

The fact that Blogbio does not proactively review all content does not mean that Blogbio endorses such content or assumes responsibility for it on behalf of the user.

6. RESTRICTIONS ON ACCOUNTS AND USER ACTIVITIES

Users must not:

  • Create fake accounts or use inaccurate information;

  • Share accounts in violation of the conditions of the applicable service plan;

  • Use another person's account without authorization;

  • Exceed or attempt to circumvent technical limitations;

  • Attack, scan, exploit, or disrupt the system;

  • Distribute malware, spam, or fraudulent content;

  • Use the system to gain unauthorized access to or interfere with third-party systems;

  • Use automated methods that generate abnormal loads or cause system overload;

  • Abuse free programs, promotional offers, or credits for personal gain;

  • Engage in activities that violate applicable laws or the rights of third parties.

Blogbio reserves the right to apply appropriate restrictions based on the nature and severity of the relevant conduct.

7. THIRD-PARTY SERVICES AND RESOURCES

Certain Blogbio features may depend on third-party services, APIs, platforms, domains, payment gateways, hosting services, or other third-party providers.

In such cases:

  • Users must comply with the terms and conditions of the relevant third-party provider;

  • Blogbio does not guarantee that third-party services will always remain available or that their policies will remain unchanged;

  • Changes by third parties to APIs, limitations, pricing, policies, or service availability may affect Blogbio functionality;

  • Blogbio may temporarily suspend or modify an integration feature where necessary.

Blogbio will make reasonable efforts to notify users when a third-party change materially affects the ability to use the services.

8. TECHNICAL LIMITATIONS AND SERVICE AVAILABILITY

Blogbio operates on technological infrastructure that is subject to certain limitations. Certain features may not be available at all times or on all devices, browsers, geographic locations, or network environments.

Blogbio may limit or modify the services when:

  • The system requires maintenance;

  • A technical error occurs;

  • There is a security or safety risk;

  • The system experiences abnormal traffic or load;

  • An infrastructure provider experiences an incident or outage;

  • Required by a competent authority;

  • Preventive or corrective measures are necessary.

Blogbio does not guarantee that all features will operate continuously, without errors, or be compatible with all user systems.

9. PAYMENT-RELATED AND ACCOUNT STATUS RESTRICTIONS

For paid services, Blogbio may restrict or temporarily suspend access where:

  • A payment is due but remains unpaid;

  • A transaction is declined by a bank or payment gateway;

  • A dispute or chargeback is under review;

  • The user uses a payment method showing signs of fraud;

  • The service plan has expired;

  • The user fails to complete required payment verification.

Before restricting or downgrading a service, Blogbio may provide notice and allow a reasonable period for the user to remedy the relevant issue, where operational circumstances permit.

Restrictions imposed due to payment issues do not discharge any financial obligations that accrued prior to such restriction.

10. SUSPENSION OR RESTRICTION OF SERVICE PROVISION

Blogbio may temporarily suspend or partially restrict the services where there are reasonable grounds to believe that continued provision may create risks to the system, users, or third parties.

Measures may include:

  • Restricting a particular feature;

  • Restricting resources;

  • Temporarily locking a website;

  • Temporarily locking an account;

  • Disconnecting third-party services;

  • Suspending content publication;

  • Requiring verification or remediation before access may be restored.

Blogbio will endeavor to provide prior notice before applying a restriction, except where immediate action is necessary to protect the system, data, or users, or to comply with applicable legal requirements.

11. TERMINATION OF SERVICE PROVISION

Blogbio may terminate part or all of the services where:

  • The user materially violates the Terms of Service or Blogbio policies;

  • The account shows signs of fraud or unauthorized use;

  • The website contains prohibited or unlawful content;

  • The user intentionally exceeds or circumvents technical limitations;

  • Required payments are not made in accordance with applicable terms;

  • There is a lawful request from a competent authority;

  • Blogbio discontinues the relevant product or feature;

  • A website under a free plan has had no activity for 60 days in accordance with the Service Termination and Refund Policy.

For websites that have remained inactive for 60 days, Blogbio may provide prior notice before deleting the website in accordance with the published procedures.

Termination due to a violation does not release the user from any obligations that remain outstanding to Blogbio or third parties.

12. DATA HANDLING WHEN SERVICES ARE RESTRICTED OR TERMINATED

When services are suspended, downgraded, or terminated, the user's access to data may be modified in accordance with the status of the account.

Blogbio may:

  • Retain data for the published retention period;

  • Allow users to export data where technically feasible;

  • Restrict the ability to edit or publish content;

  • Delete data after the applicable retention period expires;

  • Retain certain data where required by law or for accounting, tax, security, or dispute-resolution purposes.

Users are responsible for proactively backing up important data before their service plan expires, is downgraded, or their account is terminated.

Once data has been deleted in accordance with the applicable procedures, Blogbio will have no obligation to restore such data if no available backup remains or unless otherwise required by law.

13. USER RESPONSIBILITIES

Users are responsible for:

  • Using the services within the scope of their service plan;

  • Providing accurate information;

  • Protecting their accounts and authentication information;

  • Complying with resource limitations;

  • Ensuring that they have lawful rights to use their content;

  • Making all payments fully and on time;

  • Backing up important data;

  • Complying with applicable laws and Blogbio policies;

  • Proactively reviewing notices relating to their accounts and services.

Users may not require Blogbio to disregard published limitations or conditions unless otherwise agreed separately in writing.

14. BLOGBIO'S RESPONSIBILITIES

Within reasonable limits and subject to the applicable service conditions, Blogbio is responsible for:

  • Clearly disclosing the scope and limitations of each service plan;

  • Displaying pricing and applicable terms before a transaction is completed;

  • Providing services corresponding to the activated service plan;

  • Protecting data in accordance with the Privacy Policy;

  • Providing notice of material changes where reasonably appropriate;

  • Assisting users in addressing issues falling within the scope of the services;

  • Applying restrictions or termination measures based on reasonable grounds and published policies.

Blogbio is not responsible for limitations arising entirely from the user's device, network, software, third-party services, or user conduct that falls outside Blogbio's reasonable control.

15. CHANGES TO CONDITIONS AND SERVICE PROVISION RESTRICTIONS

Blogbio may update the conditions, resource limitations, feature scope, or methods of service provision where there are changes to the product, technology, operational scale, or applicable laws and regulations.

Material changes may be communicated through the website, dashboard, email, or other appropriate means.

For changes that materially reduce the benefits or increase the obligations of users who are currently using paid services, Blogbio will endeavor to provide advance notice and implement such changes at a time appropriate to the applicable service cycle, except where immediate changes are necessary to ensure system security or comply with applicable laws.

Where an organizational customer has entered into a separate contract or agreement with Blogbio, the terms of such contract or agreement shall prevail to the extent of any inconsistency.

16. FINAL PROVISIONS

This Policy shall take effect from the date it is published by Metaconex on the Website.

If any provision of this Policy is determined to be invalid under applicable law, the remaining provisions shall remain in full force and effect.

This Policy shall be governed by applicable law and shall apply together with the Terms of Service, Privacy Policy, and other policies of Blogbio.
